Last updated: [Month] 2026

1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of the PayCore360 website and the services we make available through it (together, the "Services"). PayCore360 is referred to here as "we," "us," or "our." By accessing the site or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the site or the Services.

This document is provided as a starting template and should be reviewed and adapted to your business and jurisdiction with qualified legal counsel before publication.

2. Use of the site and services

You agree to use the site and Services only for lawful purposes and in accordance with these Terms. You may not misuse the Services, interfere with their normal operation, attempt to gain unauthorized access to any systems or data, or use the Services to transmit unlawful, infringing, or harmful content.

  • Eligibility: you represent that you are authorized to enter into these Terms on behalf of yourself or the business you represent and that you can form a binding contract.
  • Accounts: if you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
  • Acceptable use: you agree not to use the Services in violation of applicable laws, payment-network rules, or the rights of others.

3. Payment terms & processing

Where you use the Services to send or receive money, payments may be processed on cards and ACH. Processing rates and platform fees are quoted to your business and are generally volume-based; the applicable rates, fees, and any minimums will be set out in your service agreement or order form with us.

By submitting a transaction, you authorize us and our payment partners to process the payment using the selected method and rail. Settlement timing, payout schedules, holds, reserves, chargebacks, returns, refunds, and dispute handling are governed by your service agreement and by applicable payment-network and banking rules. You are responsible for amounts owed in connection with chargebacks, ACH returns, refunds, and related fees as described in that agreement.

You are responsible for any taxes associated with your use of the Services, other than taxes based on our net income. If there is any conflict between these Terms and your signed service agreement regarding payment processing, the service agreement controls.

4. Intellectual property

The site, the Services, and all related content, including text, graphics, logos, software, and design, are owned by us or our licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the site and Services for their intended purpose, subject to these Terms.

You may not copy, modify, distribute, sell, or create derivative works from any part of the site or Services except as expressly permitted by us in writing. All trademarks, service marks, and trade names are the property of their respective owners.

5. Disclaimers

The site and Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site or Services will be uninterrupted, error-free, or secure, or that any defects will be corrected.

Nothing on the site constitutes legal, tax, financial, or accounting advice. You are responsible for determining whether the Services are suitable for your needs.

6. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of, or inability to use, the site or Services. Our total liability for any claim relating to the site or Services will be limited to the amount you paid to us, if any, for the Services giving rise to the claim during the period specified in your service agreement, or as otherwise required by applicable law.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

7. Changes to the terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Significant changes may be communicated through the site or by other appropriate means. Your continued use of the site or Services after changes take effect constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

8. Governing law

These Terms are governed by and construed in accordance with the laws of [jurisdiction], without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the courts located in [jurisdiction], unless otherwise required by applicable law.
